TERMS OF SERVICE

1. AGREEMENT

These Terms of Service form an agreement between you and M5Ship regarding your use of the M5Ship mobile applications, website and related services. Our Privacy Policy explains how personal information is handled and is incorporated into these terms by reference.

You must be legally able to enter into this agreement. If you use M5Ship for an organization or club, you confirm that you have authority to bind it to these terms.

2. YOUR ACCOUNT

You must provide accurate information, protect your password and promptly update information that changes. You are responsible for activity under your account unless it results from a security failure within our control. Notify us immediately at info@m5ship.com if you suspect unauthorized access.

You may not share credentials in a way that allows another person to impersonate you or use another person’s account without authorization.

3. WHAT M5SHIP PROVIDES

M5Ship provides tools for viewing and managing club memberships, member passes, class schedules and reservations, attendance records, club details and payment records. Features can differ between clubs and platforms and may change as the service develops.

M5Ship is not a payment processor in the member app. Payment records shown in the app are entered by club staff and are informational. Questions about a charge, membership fee, refund or missing record must be resolved with the relevant club.

4. CLUB RELATIONSHIPS

Each club is independently responsible for its services, facilities, schedules, membership decisions, fees, safety practices and staff conduct. M5Ship does not operate the clubs listed in the service and is not a party to your membership agreement with a club.

Class availability, capacity, cancellation deadlines and attendance status are controlled or recorded by the club. Contact the club if you believe a club-managed record is incorrect.

5. ACCEPTABLE USE

You agree not to:

• Break applicable law or violate another person’s rights.
• Access accounts, clubs, records or systems without permission.
• Upload malicious code, disrupt the service, bypass security controls or test vulnerabilities without written permission.
• Scrape, copy or use automated means to extract data except as expressly authorized.
• Misrepresent your identity, membership or eligibility for a class or service.
• Use M5Ship to harass, defraud or harm another person.

6. CONTENT AND OWNERSHIP

M5Ship and its software, design, trademarks and original content are owned by us or our licensors and protected by applicable intellectual property laws. These terms grant you a limited, personal, revocable, non-exclusive and non-transferable right to use the service for its intended purpose.

You retain rights in information you provide. You grant us permission to host, process, display and transmit it only as necessary to operate, support and improve the service and fulfill legal obligations.

7. AVAILABILITY AND CHANGES

We work to keep M5Ship reliable, but do not promise uninterrupted or error-free availability. We may maintain, change, suspend or discontinue features. When reasonably possible, we will provide notice of material changes that significantly affect active users.

8. DISCLAIMERS AND LIABILITY

To the fullest extent permitted by law, M5Ship is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or non-infringement.

M5Ship does not provide medical, fitness or safety advice. Participation in sport and training involves risk. Follow qualified instruction, club rules and appropriate medical advice.

To the fullest extent permitted by law, M5Ship will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, or conduct of a club or other user. Nothing in these terms excludes liability that cannot legally be excluded or limits your mandatory consumer rights.

9. SUSPENSION AND TERMINATION

You may stop using M5Ship at any time and may request account deletion through our account deletion page. We may restrict or terminate access if you materially violate these terms, create risk or legal exposure, or misuse the service. Where appropriate, we will provide notice and an opportunity to address the issue.

Terms that by their nature should survive termination—including ownership, disclaimers and limitations of liability—will continue to apply.

10. GOVERNING TERMS

These terms are governed by the laws applicable in Bosnia and Herzegovina, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise. Before starting a formal dispute, please contact us so we can attempt to resolve it.

We may update these terms. The revised version will be posted here with a new effective date. Continued use after the updated terms take effect constitutes acceptance where permitted by law.

11. APP STORE TERMS

If you download M5Ship through Apple’s App Store or Google Play, the store’s terms also apply. Apple and Google are not responsible for providing support for M5Ship. To the extent these terms conflict with mandatory app-store terms, the applicable store terms control.
